These Terms govern your access to and use of ZonedWeb. Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1Agreement & Definitions

These Terms of Service (the "Terms") form a binding agreement between you ("you" or "Customer") and ZonedWeb ("ZonedWeb", "we", "us"). "Service" means the ZonedWeb website, dashboard, AI builder, and hosted sites. "Content" means anything you upload, create, or have AI generate. Where a separately signed agreement (e.g. an enterprise order form or Data Processing Addendum) exists, that agreement controls over any conflicting term here.

2Eligibility & Account

You must be at least 13 (or the age of digital consent in your jurisdiction) and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Do not share your credentials. Notify [email protected] promptly of any suspected unauthorized access.

3The Service

ZonedWeb lets you describe your business and uses AI to select, generate, customize, and deploy a WordPress-based website or store. The output is real WordPress + WooCommerce that you own and may export. We may update, improve, or modify features over time; we will not materially reduce core functionality of a paid plan during your paid term without notice.

4Plans, Billing & Refunds

  • The Free plan is free and requires no payment card.
  • Paid plans bill in advance, monthly or annually, and renew automatically until cancelled.
  • You may cancel anytime from your dashboard and retain access through the end of the paid period; we do not provide prorated refunds for partial periods except as stated below or required by law.
  • Paid plans are non-refundable for the current period once it begins, because hosting and the period's AI credits are provisioned immediately. You can cancel anytime to stop renewal. We refund billing errors and material service failures — see the Refund Policy. Evaluate the product risk-free on the Free plan first.
  • Taxes may apply based on your location. Failed payments may result in suspension after a grace period.

5Your Content & License

You retain all ownership of your Content. You grant ZonedWeb a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and serve your Content solely to operate and provide the Service (for example, to publish your site to visitors). This license ends when you delete the Content or close your account, subject to routine backup cycles. You represent that you have the rights necessary to your Content and that it does not infringe others' rights.

6Acceptable Use

You agree not to use the Service to host, distribute, or facilitate:

  • Illegal content or activity, or content that infringes intellectual property or privacy rights.
  • Malware, phishing, spam, or deceptive or fraudulent schemes.
  • Child sexual abuse material or content that sexualizes minors.
  • Harassment, hate, or content inciting violence.
  • Attempts to disrupt, reverse-engineer, scrape at scale, or gain unauthorized access to the Service or other accounts.

We may investigate and suspend or remove content or accounts that violate this section, with notice where practicable and immediately where necessary to protect the Service or third parties.

7AI-Generated Content

The Service uses AI (powered by Anthropic's Claude) to generate copy, design suggestions, and customizations. AI output may be inaccurate, incomplete, or unsuitable — you are responsible for reviewing and editing it before publishing, and for the final content of your site. ZonedWeb makes no warranty as to the accuracy, originality, or fitness of AI output.

8Service Levels & Backups

We target 99.9% monthly uptime for the hosting of paid sites, excluding scheduled maintenance and events outside our reasonable control. We perform daily backups for paid plans, retained for 30 days. Backups are not guaranteed on the Free plan — export your Content regularly. Enterprise customers may request a written service-level agreement.

9Third-Party Services

The Service relies on third-party providers (e.g. Anthropic, Hetzner, Cloudflare, Stripe). Your use may be subject to their terms, and we are not responsible for third-party services or outages. See our Privacy Policy for the sub-processor list.

10Intellectual Property

ZonedWeb and its software, branding, and original materials are owned by ZonedWeb and protected by law. Templates are provided under license for use within your sites; you may not redistribute or resell the templates or platform themselves. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the Service.

11Suspension & Termination

You may cancel at any time. We may suspend or terminate access if you materially breach these Terms, fail payment, or where required by law; for Free accounts inactive for 12+ months we may reclaim resources with notice. Following termination we will delete your data within 30 days (subject to legal retention), except in cases of abuse where we may act immediately.

12Disclaimers

EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

13Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZONEDWEB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14Indemnification

You agree to indemnify and hold ZonedWeb harmless from claims, damages, and reasonable costs arising out of your Content, your use of the Service, or your breach of these Terms, to the extent permitted by law.

15Governing Law & Disputes

These Terms are governed by the laws applicable at ZonedWeb's principal place of business, without regard to conflict-of-laws rules. The parties will first attempt to resolve disputes informally by contacting us. Mandatory consumer-protection rights in your jurisdiction are unaffected.

16Changes to These Terms

We may update these Terms as the Service or law evolves. We will revise the "Last updated" date and provide notice of material changes by email or in-product. Continued use after changes take effect constitutes acceptance.

17General

These Terms (together with any documents they reference and any signed order form or DPA) are the entire agreement between you and ZonedWeb regarding the Service. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, with notice.
